By using the website, you agree to these terms to the extent enforceable under applicable law. If you do not agree, do not use the website. Our Privacy Policy explains how information submitted through the website is handled.

This website explains services and lets you contact us, request a rate or statement review, and submit an application. It is not itself a merchant processing agreement, an acquiring-bank agreement, or an agreement for use of the Translink portal.

Processing services, account eligibility, settlement, reserves, fees, equipment and other commercial terms are governed by the applicable written agreements. An enquiry, application submission or receipt confirmation does not guarantee approval, establish a processing account, or replace those agreements. If a signed service agreement conflicts with these website terms on a matter covered by that agreement, that agreement controls.

You must be an adult with legal capacity to enter agreements and have authority to submit information for the relevant business. Provide accurate, current and complete information, and notify us of material corrections to a pending request.

Only upload information you are entitled to provide. Use the designated application fields for required sensitive information. Do not include payment-card numbers, card security codes, passwords or unrelated personal information in messages or uploads.

Your submission authorises us to use and route the information to handle that request as described in the Privacy Policy. It does not substitute for a separate consent or authorisation required for a credit inquiry, identity verification, electronic signature or payment-processing agreement.

Use the website only for lawful business purposes. Do not attempt unauthorised access, disrupt availability, introduce malicious code, evade security or rate limits, impersonate someone else, submit fraudulent applications, or collect another person’s information without authorisation.

VitaPay and its licensors retain rights in the website’s design, software, text, images and other materials, except where stated otherwise. You retain rights in the material you submit. You give us permission to handle it only as needed to process your request, operate the service and fulfil applicable obligations, as explained in the Privacy Policy and any separate agreement.

The website may link to the Translink portal, payment providers or other websites. Separate terms and privacy notices may apply to those services. We are not responsible for content or operations that we do not control.

We may contact you using the details you provide to respond to your request or discuss your application. Do not rely on an automated receipt as evidence that an account has been approved or that a transaction has settled. Contact us directly if you need confirmation.

We aim to keep this website useful and accurate, but it may be interrupted or contain errors. To the extent permitted by applicable law, website content is provided “as is” and “as available,” without a promise of uninterrupted availability, complete accuracy or suitability for a particular purpose.

To the extent permitted by law, VITAPAY LLC is not liable for indirect or consequential losses arising solely from use of, or inability to use, this informational website. This provision does not govern payment-processing liability under a separate agreement, exclude liability that cannot lawfully be excluded, or limit non-waivable statutory rights. A separate service agreement may specify different rules for the services it covers. Nothing in these terms removes rights or remedies that applicable law does not allow you to waive.
