Surcharges allowed with state conditionsA seller or lessor may surcharge a customer who chooses to pay by credit or charge card instead of cash or check, up to 5% of the purchase price. It must disclose the surcharge orally and on a posted sign in person, with a conspicuous notice online, and orally by phone. A business may not surcharge its own store card; violations carry a civil penalty up to $500 and a refund of the surcharge.
