Surcharges allowed with state conditionsUtah's surcharge ban (2013 SB 67, Utah Code § 13-38a-302) sunset in July 2014, and the current Chapter 13-38a no longer contains it. The Utah Division of Consumer Protection says a fee or surcharge must be disclosed clearly and conspicuously before purchase (a receipt is too late) and may not be labelled a credit card processing fee if it exceeds the actual cost of processing. Card network rules also apply.
