Surcharging

Adding a credit card surcharge in Virginia.

No state surcharge restriction found

Virginia has no statute specifically restricting credit card surcharges. SB 1212 (2025), effective July 1, 2025, requires the total price including all 'mandatory fees or surcharges' (those that must be paid to buy the item) to be shown in advertising. A surcharge the customer can avoid by paying another way may not be 'mandatory', but no source settles this.
